Membership Agreement
1. Parties
a) Express Total Concern Import Export Tourism Construction Industry and Trade Ltd., located at Yeni Mah. Selanik Cad. No:21/A Didim - Aydın - TURKEY & Jan Rijkenstraat 7425HE Deventer / NEDERLAND, which operates the wiyango.com website (hereinafter referred to as the "SELLER").
b) The internet user who registers to the wiyango.com website will hereinafter be referred to as the "MEMBER").
2. Subject of the Agreement The subject of this Agreement is to determine the conditions under which the MEMBER may use the wiyango.com website, owned by the SELLER.
3. Rights and Obligations of the Parties
3.1. The MEMBER declares and undertakes that the personal and other information provided when registering on the wiyango.com website is true and correct before the law, and that it will immediately compensate the SELLER for any damages it may incur due to any inaccuracies in this information.
3.2. The MEMBER may not share the password provided to them by the SELLER with any other person or organization. The MEMBER has the sole right to use such password. The SELLER reserves all liability arising from this and all claims and demands that may be made against the SELLER by third parties or authorized authorities. The SELLER reserves all rights to claim compensation and other compensation arising from such unauthorized use.
3.3. The MEMBER accepts and undertakes to comply with and not violate the provisions of applicable laws and regulations when using the wiyango.com website. Otherwise, all legal and criminal liabilities arising will be fully and exclusively binding on the MEMBER.
3.4. The MEMBER may not use the wiyango.com website in any way that disrupts public order, violates morality, disturbs or harasss others, for any illegal purpose, or infringes on the intellectual or copyright rights of others. Furthermore, the MEMBER may not engage in any activity or process that prevents or obstructs others from using the services (spam, viruses, Trojan horses, etc.).
3.5. The opinions and ideas expressed, written, and used by members on the wiyango.com website are solely the members' personal opinions and are solely the sole responsibility of the opinion holder. These opinions and ideas have no connection or affiliation with the SELLER. The SELLER has no liability for any damages that third parties may suffer due to the opinions and views expressed by the MEMBER, or for any damages that the MEMBER may suffer due to the opinions and views expressed by third parties.
3.6. The SELLER shall not be responsible for unauthorized access to the MEMBER's data or for any damage to the MEMBER's software and data. The MEMBER agrees in advance not to claim compensation from the SELLER for any damages they may incur due to the use of the wiyango.com website.
3.7. The MEMBER agrees not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this will be entirely the MEMBER's responsibility.
3.8. A MEMBER who violates one or more of the articles listed in this membership agreement shall be personally and criminally liable for this violation and shall hold the SELLER harmless from the legal and criminal consequences of such violations. Furthermore, if the incident is brought to court due to this violation, the SELLER reserves the right to claim compensation from the MEMBER for non-compliance with the membership agreement.
3.9. The SELLER reserves the right to unilaterally terminate a MEMBER's membership and delete customer files, documents, and information at any time, if necessary. The MEMBER hereby accepts this disposition in advance. In this case, the SELLER has no liability.
3.10. The software and design of the wiyango.com website are owned by the SELLER, and the copyright and/or other intellectual property rights related to them are protected by relevant laws. They may not be used, acquired, or modified by the MEMBER without permission. Other companies and their products mentioned on this website are the trademarks of their respective owners and are also protected by intellectual property rights.
3.11. SELLER may collect certain information, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the wiyango.com website, the date and time the site was accessed, the pages accessed during the visit, and the Internet address of the website providing direct access to the site, for the purpose of improving and developing the wiyango.com website and/or in accordance with legal regulations.
3.12. SELLER may use members' personal information to provide better service to its users, improve its products and services, and facilitate site use by addressing users' specific preferences and interests. SELLER reserves the right to keep records of the MEMBER's actions on the wiyango.com website.
3.13. By becoming a member of the SELLER, the SELLER declares and agrees to be provided with product and service promotions, advertisements, campaigns, advantages, surveys, and other customer satisfaction applications within the scope of current and/or future practices. The MEMBER declares and agrees to allow the SELLER to collect, share, use, and archive the personal and shopping information, as well as shopping and/or consumer behavior information, provided in the past and/or in the future upon becoming a SELLER member and/or through other means, for the purposes set forth above. Unless otherwise stated, the MEMBER declares and agrees to allow the collection, sharing, use, and archive of data by the SELLER upon termination of their membership. Unless otherwise stated, the MEMBER declares and agrees that they allow the SELLER to contact them via communication channels such as the internet, telephone, SMS, etc. The MEMBER declares and agrees that they will not claim, and will not hold the SELLER responsible for, any direct and/or indirect material and/or moral, negative and/or positive damages arising from the collection, sharing, use, archiving, and access to the aforementioned information. If the MEMBER wishes to change their data sharing preferences, they may submit this request to the SELLER's customer service call centers.
3.14. SELLER may disclose MEMBER's personal information when required by law or when it believes in good faith that it is necessary to (a) comply with legal requirements or comply with legal processes served on SELLER; (b) protect and defend the rights and property of SELLER and the SELLER website family.
3.15. SELLER has taken measures to the best of its ability to ensure that the SELLER website is free of viruses and similar malicious software. Furthermore, to ensure ultimate security, the user must provide their own virus protection system and ensure the necessary protection. In this context, by accessing the SELLER website, the MEMBER accepts responsibility for all errors that may occur in their software and operating systems, and for any direct or indirect consequences thereof.
3.16. SELLER reserves the right to change the content of the site at any time, modify or terminate any service provided to users, or delete user information and data stored on the SELLER website.
3.17. SELLER may change, update, or cancel the terms of the membership agreement at any time without prior notice and/or warning in any form. Any amended, updated, or repealed provision will be effective for all members on the date of publication.
3.18. The parties acknowledge and declare that all computer records belonging to SELLER will be considered the sole and exclusive evidence in accordance with Article 287 of the Civil Procedure Code, and that such records constitute an evidentiary contract.
3.19. In accordance with this membership agreement, the SELLER is authorized to send information e-mails to its members' registered e-mail addresses and information SMS messages to their mobile phones. By approving this membership agreement, the MEMBER will be deemed to have accepted the sending of information e-mails to their e-mail addresses and information SMS messages to their mobile phones.
4. Termination of Agreement
This agreement shall remain in effect until the MEMBER cancels their membership or until the SELLER cancels their membership. The SELLER may unilaterally terminate the agreement by canceling the MEMBER's membership if the MEMBER violates any provision of the membership agreement.
5. Dispute Resolution
Consumer Courts and Enforcement Offices have jurisdiction over disputes related to this agreement. 6. Enforcement
A MEMBER's registration for membership signifies that the MEMBER has read and accepted all the terms of the membership agreement. This agreement is concluded and mutually effective upon the MEMBER's registration.
